1 Acceptance of the general conditions of sale

1.1 The contract stipulated between the Seller and the customer shall be deemed concluded with the acceptance, even partial, of the order by the Seller. This acceptance is deemed tacit. By placing an order through the various methods provided, the customer declares having read all the information provided during the purchase process and fully accepts the general and payment terms and conditions set forth below.

1.2 Once the online purchase procedure has been completed, the Customer or consumer must print or save an electronic copy and, in any case, retain these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

1.3 The Customer is excluded from any right to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

2 Purchase Methods

2.1 The Customer may only purchase the products present in the Seller's electronic catalogue at the time of placing the order and viewable online at the Website address.

2.2 Correct receipt of the order is confirmed by the Seller via email, sent to the email address provided by the Customer. This confirmation message will include the date and time the order was placed and an "Order Number," to be used in all further communications with the Seller's staff. The message will contain all the information entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections, according to the methods described in this document.

2.3 In the event of non-acceptance of the order, the Seller's staff will ensure timely communication to the Customer.

3 Prices

All prices shown to end users on the Website include VAT (22%). Product prices are subject to change without notice.

4 Images

The images accompanying the product description are for illustrative purposes only, to allow for a better understanding of the various colors. The images of the advertised products may not be fully representative of their features but may differ in color, size, and accessory products shown in the image.

5 Payment Methods

5.1 Credit Card

For purchases made using Visa, MasterCard, and American Express credit cards, or Maestro-enabled debit cards, upon completion of the online transaction, the relevant banking institution will authorize the commitment of the purchase amount only. The amount for the goods shipped, even partially, will be charged to the Customer's credit card only when the goods are shipped from our warehouse. If the order is cancelled, either by the Customer or if the Seller rejects the order, our staff will simultaneously request cancellation of the transaction and release of the committed amount. Release times depend exclusively on the banking system and may extend until their natural expiration (24 days from the authorization date). Once the transaction has been cancelled, the Seller cannot be held liable under any circumstances for any direct or indirect damages caused by a delay in the banking system's failure to release the committed amount. In the event that the Customer's order is processed after the 23rd day from the date of placement, the Seller will still charge the Customer's credit card for the amount due, even before the actual delivery of the goods, in order to avoid the transaction authorization expiration (24 days). The Seller reserves the right to request additional information from the Customer (e.g., landline phone number) or copies of documents proving ownership of the card used. In the absence of the requested documentation, our staff reserves the right to refuse the order. At no point during the purchase process will the Seller be able to access the buyer's credit card information, which is transmitted via a secure connection directly to the website of the banking institution managing the transaction. The Seller will not store this data in any computer archive. Therefore, under no circumstances can the Seller be held liable for any fraudulent or improper use of credit cards by third parties when paying for products purchased on the Website.

5.3 PayPal

In the case of purchases of goods using PayPal payment methods, PayPal will immediately charge the amount relating to the purchase made upon completion of the online transaction.

6 Shipping methods, delivery costs and Customer Service reports

6.1 The Seller can only accept orders for delivery within Italy and other European Union countries. Deliveries to Livigno and Campione d'Italia are excluded. For all countries outside the European Union, specific documents will be required for each country and customized delivery charges will be provided.

6.2 Each order shipped is accompanied by a detailed Transport Document as required by Presidential Decree no. 696 of 21 December 1996. An invoice is issued only if requested at the time of ordering by indicating your VAT number in the appropriate field. The document can be downloaded from the specific section within your account on the Website.

NB: It is not possible to request an invoice for a previously fulfilled order.

6.3 Shipping costs are the responsibility of the Customer and are clearly stated when placing the order. Payment for the goods will be made using the method chosen when placing the order. The Customer owes nothing more than the order total shown at the end of the purchase process.

6.4 Seller srl cannot be held liable for any delays in processing the order or in delivering the goods ordered.

6.5 Upon delivery of the goods by the courier, the Customer is required to check that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials (adhesive tape or strapping). Any damage must be immediately reported to the courier making the delivery. Once the courier's delivery document has been signed, the Customer may not raise any objections regarding the external characteristics of the delivered goods.

Any problems regarding the physical integrity, correspondence, or completeness of the products received must be reported to Customer Service no later than 15 days after delivery.

6.6 In the event of failure to collect the material stored at the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer when ordering, the order will be automatically cancelled.

7 Product availability

Only products physically available in stock can be ordered on the Website. The integrated stock availability feature is accurate, however, there may be small delays in communicating the actual stock level and the status shown on the website. Therefore, in some rare cases, item availability cannot be guaranteed with certainty. If one or more ordered items are not immediately available for shipment, our staff will decide, based on the size of the order and the expected restocking time, to proceed with one of the following solutions:

- immediately process the available material and send the missing products as soon as they become available again without any additional shipping costs;

- contact the customer who will choose whether to receive the material in a single shipment, delaying order processing, or cancel the unavailable products from the order.

8 Right of withdrawal

8.1 If the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his or her professional activity, or does not indicate a VAT number in the order form to the Seller), he or she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following point 8.3.

8.2 To exercise this right, the Customer must send the Seller a communication to this effect within 14 working days from the date of receipt of the goods.

This communication must be sent via one of the following means:

- Registered letter with acknowledgement of receipt, addressed to the Seller's registered office.

- Fax always sent within the aforementioned 14-day period and followed by a confirmation by registered letter with acknowledgement of receipt, sent strictly within the following 48 hours.

- EMAIL.

8.3. The right of withdrawal is in any case subject to the following conditions:

- The right applies to the product purchased in its entirety;

- It is not possible to exercise the right of withdrawal on only part of the purchased product;

- The purchased item must be intact and returned in its original packaging, complete in all its parts;

- By law, the shipping costs for returning the goods are the responsibility of the customer;

- The shipment, until received in our warehouse, is under the complete responsibility of the customer;

- In the event of damage to the goods during transport, the Seller will notify the customer of the incident (within 5 days of receiving the goods at its warehouses), allowing the customer to promptly file a complaint with the courier of their choice and obtain a refund for the value of the goods (if insured). In this case, the product will be made available for return to the customer, simultaneously canceling the withdrawal request.

The Seller is not responsible for damage or theft/loss of goods returned via uninsured shipments. Upon arrival at the warehouse, the product will be inspected for any damage or tampering not caused by transport. If the returned product is damaged, the Seller will deduct a percentage from the refund due to cover the repair costs.

8.4 Except for any repair costs for confirmed damage to the original packaging, the Seller will refund the customer the full amount already paid for the goods (excluding shipping costs) by bank transfer or PayPal within 14 days of the return of the goods. The customer is responsible for promptly providing the bank details for the refund (name, surname, account holder, IBAN code).

8.5 The right of withdrawal lapses entirely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where the Seller ascertains:

- The lack of integral elements of the product;

- Damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, the Seller will return the purchased item to the sender, charging the latter the shipping costs.

9 Guarantees

Products purchased on the Website are subject to the provisions, where applicable, of Legislative Decree 2.2.2002 n. 24 (Official Journal n. 57, 8.3.2002) on sales contracts and guarantees concerning consumer goods and, for anything not covered therein, to the specific provisions set forth in the Civil Code.

This warranty will apply to products that present defects of conformity and/or malfunctions that were not detectable at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in compliance with its intended purpose and with the provisions of any technical documentation, with observance of the various operating instructions indicated therein.

The aforementioned warranty will not apply in the event of negligence, careless use and maintenance of the product, or improper use. The warranty is personal and therefore applies only to the original purchaser, being reserved for direct customers and not to dealers, resellers, etc.

Any product packaging defects must be reported within 15 days of receiving the goods. The customer must include a written notification when returning the defective product.

To be eligible for replacement, even if the product is defective, it must be returned to the Seller complete with its packaging and all accessories and documentation received by the customer at the time of purchase. Returning the product without the original packaging, accessories, and documentation described above will prevent the Seller from replacing the product at the manufacturer's premises and will make the replacement impossible.

The Seller reserves the right to verify the actual defect reported by the customer and to replace the item only after such inspection. The request will be processed only if the following documents are included in the returned package: a copy of the purchase invoice or cash on delivery receipt, order number and date, and a brief description of the defect found. The costs of returning the item to the sender are the responsibility of the Customer.

10 Privacy

10.1 The personal data requested during registration on the site and order placement are collected and processed in order to satisfy the Customer's requests.

Such data will also be processed for institutional purposes, connected or instrumental to our company's activity, namely:

- To perform a service or one or more operations, contractually agreed upon;

- To fulfill legal obligations;

- For operational and management needs;

- For monitoring the progress of customer relations;

- For operational and strategic marketing purposes;

- To send advertising material or commercial information.

Personal data will not be disclosed to third parties under any circumstances or for any reason. The Seller guarantees its customers compliance with the legislation regarding the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree 196 of June 30, 2003. The data controller is the Seller.

NB: By registering on the site or placing an order, you give tacit consent to the processing of personal data in accordance with Legislative Decree 196 of 30.06.03.

12 Complaints

12.1 Any complaints must be addressed to the Seller by registered mail or EMAIL.

12.2 For any problems or anomalies encountered, before filing a complaint, the Customer is invited to contact the Seller's staff via the dedicated section on the website. In almost all cases, any problem or misunderstanding is resolved within a few hours.

13 Applicable law

The sales contract between the Customer and the Seller is deemed to have been concluded in Italy and is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, the exclusive jurisdiction lies with the Court of competent jurisdiction indicated at the bottom of the document.

14 Further insights

The Seller believes in the quality of its products and strives to offer the best quality ingredients on the market. Given this, please note the following:

- Make sure you are not allergic to any of the ingredients or materials in the products before application;

- The Seller shall not be held responsible for any reactions to the ingredients or materials of the products sold;
